Did you know the Energy Efficiency requirements are changing in 2020 and are you ready?
As you are probably aware, the Energy Efficiency Regulations 2015 established a minimum level of energy efficiency for privately rented property in England and Wales. This meant that, from April 2018, landlords of privately rented domestic and non-domestic property in England or Wales must ensure that their properties reach at least an Energy Performance Certificate (EPC) rating of E before granting a new tenancy to new or existing tenants.
From 1 April 2020, these requirements will change and all domestic private rented properties in England and Wales must reach an EPC E rating even where there has been no change in tenancy arrangements. These regulations will also apply to non-domestic properties from 1 April 2023.
MEES (Minimum Energy Efficiency Standard) in Scotland follow slightly different time frames. The guidelines here state that from 1 April 2020 a property must reach a minimum E rating on the EPC and will most likely progress from there to a minimum D rating from 1 April 2022.
The regulation changes across the country, however, will mean that landlords and managing agents will need to ensure that EPC standards are met for their properties at a change of tenancy, and whilst there is a cost cap of £5,000 for any required works needed for a property to meet the required EPC banding, there will be civil fines for non-compliance.
